Terms of Use Agreement

Introduction: Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal effects resulting from your use of the store's services over the internet via this electronic platform. Any person's use of the store—whether as a consumer of a service or product or otherwise—constitutes their consent, acceptance, and full legal capacity (sharia-compliant and statutory) to all articles and provisions of this agreement. This is a confirmation of your commitment to its regulations. This agreement applies to all types of dealings between the consumer and the store. This agreement is considered effective and valid once you agree to it and begin registering in the store, pursuant to Article 10 of the Saudi Electronic Transactions Law.

Article 1 - Introduction and Definitions:

The above preamble is an integral part of this agreement. Below are the definitions for the key terms used in this agreement:

1. (The Store): This definition includes all forms of the store on the internet, whether it is an electronic application, a website, or a physical retail outlet.
2. (The Consumer): Any person who engages in electronic commerce seeking to obtain products or services provided by the store via its electronic platform.
3. (The Agreement): Refers to the terms and conditions of this agreement, which govern the relationship between the parties involved.

Article 2 - Consumer's Legal Capacity:

1. The consumer acknowledges that they have the legal capacity recognized by Sharia and the law to deal with the store, or that they are at least eighteen (18) years of age.
2. The consumer agrees that in the event of violating this article, they shall bear the consequences of such violation toward third parties.

Article 3 - Nature of Obligation:

1. The store’s obligation toward consumers is to provide the (Service or Product).
2. The store may provide other services, such as after-sales services or other related services, depending on the nature and type of (Service or Product) requested by the consumer.

Article 4 - Usage Guidelines:

1. The consumer undertakes to use the store’s electronic platform in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2. The consumer undertakes, when purchasing a service or product from this store, not to use said service or product in a manner that violates public morals or the regulations in force in the Kingdom of Saudi Arabia.

Article 5 - Accounts and Registration Obligations:

Upon applying for membership in this store as a user, you are obligated to disclose specific information and choose a username and a secret password for use when accessing the store's services. By doing so, you agree to:

1. Be responsible for maintaining the confidentiality of your account information and password, and notify the store immediately of any unauthorized use of your account or any other breach of your confidential information.
2. The store shall not, under any circumstances, be liable for any loss—direct or indirect, moral or material—resulting from the disclosure of your username or password.
3. You are committed to using your account or membership yourself, as you are fully responsible for it. If used by someone else, it is presumed that you have authorized them to use the store in your name and for your account.
4. You commit to using the store with seriousness and credibility.
5. You commit to disclosing true, accurate, current, complete, and legal information about yourself as required during registration, and you commit to updating your data if it changes in reality or when necessary.
6. The store is committed to treating your personal information and contact addresses with strict confidentiality.
7. If it appears to the store that you have disclosed information that is untrue, inaccurate, outdated, incomplete, illegal, or in violation of the Terms of Use, the store reserves the right to suspend, freeze, or cancel your membership, account, or store on the platform, without prejudice to the store's other rights and legitimate means to recover its rights and protect other consumers.
8. In case of non-compliance with any of the above, the store management has the right to suspend or cancel your membership/store or block you from accessing the store's services again.

Article 6 - Electronic Communications and Official Means of Communication:

1. The parties to this agreement agree that communication shall be conducted via the email registered on the platform.
2. The consumer agrees that all agreements, advertisements, disclosures, and other communications provided electronically serve as their written counterparts and are self-evident proof in meeting legal and Sharia requirements.
3. The consumer agrees to the possibility of being contacted and notified of any provisions regarding this agreement or dealings with them through general messages broadcasted by the store management to all consumers or specific users.

Article 7 - Amendments to the Terms of Use and Fees:

1. If any article or clause in this agreement is canceled or is no longer enforceable, such an event does not invalidate the validity of the remaining articles, clauses, rules, and provisions, which shall remain in effect until further notice from the store management.
2. This agreement—which may be amended from time to time—constitutes the mechanism of action, understanding, and agreement between the (Consumer) and the (Store).

4. The store may impose fees on some consumers depending on the offers, products, or services they request, or any fees or taxes imposed by the state on the nature of the product or service.

6. The store reserves the right to add, increase, decrease, or discount any fees or expenses under the terms and conditions of the User Agreement for any consumer, regardless of their registration reason.

Article 8 - Payment and Settlement Services:

1. The store provides, through its partners, a payment system that can be conducted entirely online through the payment options available on the store or any payment method provided by the store from time to time.
2. The store is committed to pricing the service or product it offers according to the recognized market value.
3. The store is committed to providing invoices and receipts for all amounts and profits arising in its store and is committed to giving the consumer an invoice for their purchase.
4. The store is committed to providing recognized accounting specifications in its electronic store in application of the provisions of this agreement.

Article 9 - Intellectual Property:

1. The intellectual property rights of the store are fully owned by the store, whether owned before or after the establishment of this electronic platform.
2. The consumer respects the intellectual property rights of the store, including the store's name, words, logos, and other symbols of the store or those displayed on it.

Article 10 - Liability of the Store:

1. The store is committed to conducting its commercial business via this electronic platform in a regular manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia.
2. The store shall not be liable for any claims arising from errors or negligence, whether caused directly, indirectly, accidentally, by the consumer, or by a third party such as shipping companies.
3. [Store Name], its employees, and owners commit that the (Product or Service) shall be sound, legitimate, and authorized according to the laws of the Kingdom of Saudi Arabia.

Article 11 - Restriction of Access or Membership:

The store may suspend or cancel a consumer's membership or restrict a consumer's access to the platform's services at any time, without notice, and for any reason.

Article 12 - Applicable Law:

This User Agreement is governed and formulated according to the laws and regulations in force in the Kingdom of Saudi Arabia.

Article 13 - General Provisions:

If any article or clause in this User Agreement is canceled or is no longer enforceable, such an event does not invalidate the validity of the remaining articles.

1. Arabic is the language applicable for interpreting the provisions of this agreement.
2. All prices displayed may be amended from time to time.
3. Promotional or marketing offers are temporary, and the store has the right to modify or stop them at any time.
4. The parties commit to dealing in a manner that does not violate Sharia rules and applicable laws.
5. This agreement shall not be canceled except by a decision issued by the store management.
